These Terms govern your access to and use of the VIP-Real Estate website, mobile experiences, client portal, and related services (collectively, the “Service”). By using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Use of Site
You may use the Service for lawful, personal, non-commercial purposes related to your interest in Toronto-area real estate and mortgage services. You agree not to:
- Use the Service in any way that violates applicable law or regulation.
- Interfere with or disrupt the integrity or performance of the Service.
- Attempt to gain unauthorized access to any portion of the Service or its related systems.
- Reverse-engineer, decompile, or otherwise attempt to derive the source code of any part of the Service.
- Impersonate any person or misrepresent your affiliation with any person or entity.
2. IDX and Listing Data Restrictions
Listing content displayed on the Service is provided under license from the Toronto Regional Real Estate Board (TRREB) and the Canadian Real Estate Association (CREA). REALTOR®, MLS®, and the associated logos are trademarks of CREA. Listing content remains the property of the listing brokerage. You may view listings for personal, non-commercial use only. You must not:
- Scrape, harvest, crawl, or otherwise systematically extract listing content from the Service by any means, manual or automated.
- Redistribute, republish, or syndicate listing content to any third party, whether for free or for compensation.
- Use listing content to train or fine-tune any machine-learning model without our prior written consent and the consent of the listing broker and TRREB.
- Remove, alter, or obscure any trademark, copyright, or proprietary notice contained within listing content.
We reserve the right to throttle, restrict, or terminate access for any user whose activity appears inconsistent with personal, non-commercial use.
3. Account Responsibilities
If you register for an account, you are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. You agree to:
- Provide accurate, current, and complete information at registration.
- Promptly update your information as it changes.
- Notify us immediately of any unauthorized access or suspected breach.
- Not share your account with any other person.
We may suspend or terminate accounts that violate these Terms or that show signs of compromise or misuse.
4. Brokerage and Mortgage Services
The Service is operated by VIP-Real Estate, a brokerage registered with the Real Estate Council of Ontario (RECO) and licensed under TRESA, and a mortgage brokerage licensed under the Mortgage Brokerages, Lenders and Administrators Act, 2006 and regulated by the Financial Services Regulatory Authority of Ontario (FSRA). Use of the Service does not, by itself, create a client or agency relationship. A client relationship is created only by a written representation, buyer representation, or mortgage agreement signed by you and an authorized representative.
5. Disclaimers
The Service is provided “as is” and “as available.” While we work to keep information accurate, we make no warranties about the completeness, reliability, suitability, or availability of the Service or any content within it. Property information, including measurements, taxes, and condition, is sourced from third parties and must be independently verified before any purchase decision. Mortgage rates, qualification estimates, and calculator outputs are illustrative only and do not constitute an offer of credit.
To the maximum extent permitted by law, VIP-Real Estate and its principals, agents, and licensors disclaim all warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose, and non-infringement.
6. Limitation of Liability
To the maximum extent permitted by law, in no event shall VIP-Real Estate be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Service. Our total aggregate liability for any claim relating to the Service shall not exceed one hundred Canadian dollars (CAD $100), or the amount you paid us for the service giving rise to the claim, whichever is greater.
7. Indemnification
You agree to indemnify and hold harmless VIP-Real Estate, its directors, officers, employees, and agents from and against any claims, losses, damages, liabilities, and expenses arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
8. Termination
We may suspend or terminate your access to the Service at any time, without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users or to the Service.
9. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising out of or in connection with these Terms shall be brought exclusively in the courts of the City of Toronto, and you consent to the personal jurisdiction of those courts.
10. Changes to the Terms
We may modify these Terms from time to time. The current version will always be posted on this page, with the “Last updated” date revised accordingly. Material changes will be communicated through the Service or by email to registered users.
